Meeting called to order @ 7:05pm
- Introductions of the board and residents
- Discussion about adding board members – Jim Smith (member at large) is stepping down. Kathy Eisenbeis agreed to join prior to meeting. Crystalle Bozarth volunteered as well.
- A motion was made and passed to elect the following officers – Aaron Schmidt to remain President. Jason Cole to remain Treasurer. Steve Wood now Vice President. Joe Gray now Secretary.
- Review prior year budget (period end 03/23)
- $15,200 operational vs $16,390 actual costs. Main drivers of overage = Water and Lawn Care costs.
- Discussion included: pulling funds from capital budget to cover operational budget, adding expenses such as cameras at entrances, snow removal, security on the 4th of July, and other legal fees.
- Budget assumes anywhere from 147 to 150 homes pay timely of 174 homes in the neighborhood
- Review current year budget (period end 03/4)
- $17,099 expected spend compared to $16,390 prior year. Water and Lawn Care right-sized.
- Discussion around increasing annual dues. Current $100 has been in place since at least the early 1990’s.
- A motion was made and passed to increase dues to $150 annually. Estimated additional $5K to $7K HOA income for operational spend. The $150 rate will not kick in until 2024-2025 fiscal year.
- Discussion around past due lots & collections/escalation process including litigation and foreclosure.
- 20+ lots are currently past-due with 5 to 6 lots making up largest shortfalls. (These lots are liened-up)
- The board will work to improve the payment and collection process going forward including:
- Send annual dues notices on time and include self-addressed stamped envelopes
- Electronic payment acceptance (QuickBooks/Venmo/direct payment to bank)
- Links/notices on website and FB page
- 30 day reminder, 60 day attorney letter, and 90 day lien process for past-due lots
- Discussion around Covenants/Restrictions which have been in place since the neighborhood was established
- Current covenants are vague with room for interpretation
- 100% of all HOA lots must vote to amend a restriction with a 51% majority to pass
- Additional income from dues increase will go to legal spend to amend any covenants
- Discussion around LONG-TERM rentals (the board heard members for and members against)
- Federal law prohibits exclusion of long-term rentals entirely (Civil Rights Act)
- A motion was made and passed for the board to explore amending restrictions to discourage long-term rentals. The board will discuss with current legal counsel and report back to the members.
- Discussion around SHORT-TERM rentals (AirBnB/Vrbo) (most members were against)
- Existing Covenant #1 includes a restriction against “…Commercial Business, Enterprise, or Trade…”
- A motion was made and passed for the board to explore amending restrictions to severely restrict or prohibit AirBnb/Vrbo type activity specifically. The board will discuss with current legal counsel and report back to the members.
